Hippolytus and Carmen de Paz Agulló parents, a child of eleven years with PCI. How many caregivers and caregivers of dependent people, we believe that everything would change in 2006 when it passed the Law on the Promotion of Personal Autonomy better known as Law Unit. Also, like many, we request the aid and eagerly expected a change in our lives, but the Department of Social Welfare did not solve the speed with which our record and we were required to approve the aid in 2008 without recognizing the retroactivity provided for in the law and must have been the High Court of Valencia who give us reason.
The road has been long
have had many administrative obstacles and have been sent to many government documents that require time and again, as we have suffered
ningunejaven phones intended for information counseling us through to another department without a response,
we had to see the media as leaders Valencia teased us by saying that the law was to apply a regular basis when they had, or that create now have available the services configured
we had to go to the Ombudsman, the Ombudsman, the politicians of our community and see how any of these ways has served for more that to get a picture and leave the press saying how they care about us,
we had to see how the Department of Social Welfare had ignored the recommendations of the Ombudsman although he had acknowledged and accepted why we had to mobilize
us and be part of the Platforms in Defense of the Law Unit, go to demonstrations, rallies, lectures, debates, ... and always with our son over to everyone coneguera reality first-hand
we had written to the press to inform citizens of what is happening with the dependent and we had to verify that the problem of our collective group does not matter to anyone, even themselves dependent
we had to stop carrying out what is truly important that is to share our time with our son and we had to take care of us papers and attend the college of lawyers seeking help because Our records were too small to be letter understood
we had to make an appeal because the decision of the Regional Secretary for Social Welfare Program which was approved Individual Care Unit did not meet the 04/10 rule Decree 171/2007 which recognized the right to the service from the day of submitting the application, we had to endure as
Mr. David I. Calatayud, regional secretary of family and social coordination, we responded to an appeal by telling us that we have proven that our child receives care within the family from the date of application,
we had to to denounce our case in court through an Administrative Dispute because, Valencia was not admitted by the Court of Trustees.
Finally, last Friday 28 January the High Court of Valencia (Administrative Dispute Chamber, fifth section), ruled that the Department of Social Welfare had not done our homework and this sentence to recognize the retroactivity of the help that they deserve. Maybe we corresponding significant economic aid and perhaps never come to collect it, but we do not take anyone's pleasure to hear that someone recognized that we were right, that our efforts to voice our voice has not fallen on deaf ears and, why not, to restore faith in justice, but for its slowness has caused us serious emotional problems. We are also pleased that this decision creates a precedent for other similar cases that have come to report to court are resolved in favor of dependent people, but unfortunately there are many other cases, perhaps too, have not had the opportunity to do so for very different reasons.
Thanks to everyone who have supported us, who have you trusted us and those we have heard and, although this sentence we have gone a step further, we recognize that the fight is not over yet.
